Forest7.8aPlease provide details of your region's forests-related policies.6Policy description and region’s role in its enforcement3O Maranhão possui um macrozoneamento (escala de 1: 1.000.000) estabelecido pela Lei Estadual 10.316/2015 e elaborado pela Embrapa e a Secretaria de Planejamento (SEPLAN). Segundo o Instituto Maranhense de Estudos Socioeconômicos e Demográficos (IMESC), este zoneamento apresentou peças técnicas sobre o estado, porém sem agregar elementos de planejamento territorial. De fato, esse é um dos principais desafios do zoneamento, a articulação de secretarias e diferentes atores sociais para que o instrumento de fato seja utilizado no planejamento territorial. Uma segunda aproximação, na escala de 1:250.000, foi elaborada sob coordenação do IMESC e em outubro de 2019 iniciaram as consultas públicas para ouvir a população residente no território que compõe o Bioma Amazônico do Estado sobre o zoneamento. Esse ZEE tem como recorte territorial a Amazônia Maranhense, que corresponde a 80% do território do estado. No Maranhão o ZEE é estabelecido como instrumento da Política Florestal e de Proteção da Biodiversidade do Maranhão (Lei 8.528/2006) e deve ser base para a discussão e planejamento do uso do solo pelos diversos setores da sociedade. Com o avanço da tecnologia digital e a disponibilização de imagens e análises espaciais, o ZEE precisa ser pensado de forma agregada a outros instrumentos. Um exemplo de integração importante é com o Cadastro Ambiental Rural (CAR), estabelecido pelo Código Florestal (Lei 12.651/2012). Atualmente, o CAR provê um banco de dados das propriedades rurais do estado e, devido sua função e uso, está mais atualizado do que as peças técnicas do ZEE. Através do ZEE pode haver a integração de bases cartográficas relevantes o processo do CAR, uma vez que divergências entre dados do IBGE e dados de outras fontes oficiais sobre os limites dos municípios, estados e das diversas categorias de uso da terra podem ser discutidos e alinhados. Dessa forma, é fundamental que ambos instrumentos sejam trabalhados de forma conjunta para o planejamento territorial. O ZEE agrega elementos da paisagem (biológicos e geográficos), assim como aspectos socioeconômicos, e o CAR provê informações sobre o atual uso da terra e sua situação ambiental em relação ao cumprimento do Código Florestal. A identificação das diferentes áreas e suas potencialidades, o atual uso da terra e o uso desejado em cada região do estado devem orientar o processo de uso e ocupação do solo regrado e definido pelo licenciamento ambiental do estado. É importante destacar a importância do ZEE no reconhecimento dos territórios de povos e comunidades tradicionais. Uma vez que o zoneamento identifica essas áreas, elas devem ser utilizadas para a definição das zonas e atividades que podem ser desenvolvidas, considerando tanto o aspecto de conservação dos territórios tradicionais e da sociobiodiversidade associada, quanto em termos de produção rural. Nesse sentido, é fundamental que não apenas Terras Indígenas e Unidades de Conservação sejam reconhecidas, como também outros territórios tradicionais como as Áreas Remanescentes Quilombolas e os assentamentos diferenciados voltados para outros grupos de populações tradicionais. O ZEE também deve ser utilizado de apoio nos processos de inteligência territorial na produção de grãos no estado (INPUT, 2017). Atualmente está em fase de consulta pública no estado o Zoneamento Agropecuário do Maranhão (ZAMA). A iniciativa, liderada pela SAGRIMA e a Universidade Estadual do Maranhão (UEMA), tem como principal objetivo minimizar os riscos relacionados aos fenômenos climáticos e permitir, em nível regional, identificar a melhor época de plantio das culturas, nos diferentes tipos de solos e ciclos de cultivares.
